CENTRAL ANTI-CORRUPTION BUREAU always in the interest of Poland Irregularities in military public procurement – joint action of the CBA and the Military Police - News -

Officers of the Regional Office of the CBA in Poznań and soldiers from the Military Police Department in Wędrzyn, under the supervision of a prosecutor from the 8th Military Affairs Department of the District Prosecutor’s Office in Poznań, are jointly conducting an investigation into the abuse of powers and failure to fulfill duties by a public official,  a civil servant of the Polish Army. His actions, carried out in order to obtain financial benefits, were detrimental to the public and private interest.

The findings show that the senior technician of the Technical Property Maintenance Section of the Military Economic Branch in Wędrzyn (hereinafter referred to as WOG), from March 2022 to December 2023, in connection with public procurement procedures organized in WOG (without tenders), exceeded his rights and failed to fulfill his obligations.

As a member of the commissions awarding orders and accepting completed works, he also participated in formulating offers by the construction company that applied for orders from WOG. The man also accepted previously forged documents as authentic.

As it was later determined, the company was founded on the so-called pole, with the inspiration of the suspect himself and with the cooperation of his brother, who actually managed it together with the suspect’s wife. Additionally, the way the company carries out the orders awarded to it is also questionable.

The company obtained orders from WOG for renovation and construction works. This was in violation of the WOG public procurement regulations. The value of the concluded contracts amounted to almost PLN 650,000. These actions constituted damage to the public and private interests of other entities to which the contracts in question were not awarded.

Detention of the suspects with assistance of the Military Police

On July 8-9, 2024, officers of the Regional Office of the CBA in Poznań detained three men in the Lubuskie Voivodeship involved in the criminal activities described above. Searches were carried out at the places of residence of the detained persons in order to secure financial and accounting documentation, electronic devices and other items that could constitute evidence in the case.

Together with CBA officers, soldiers from the Military Police Department in Wędrzyn carried out the activities. They conducted searches on the premises of the 45th Military Economic Department in Wędrzyn, during which they secured documentation related to proceedings organized by WOG, interviewed witnesses (soldiers and civil servants), and also provided a guide with a dog trained to search for banknotes and two forensic ambulances that served as mobile interview offices.

Preventive Measures Applied

Preventive measures were taken against the senior technician in the form of a property surety in the amount of PLN 30,000, suspension from official duties, police supervision and a ban on contacting suspects and other persons indicated by the prosecutor. The second detainee was placed under police supervision, banned from contacting other suspects and banned from leaving the country. The third detainee was granted bail in the amount of PLN 20,000, police supervision and a ban on contacting suspects and other specific persons.

Moreover, in the case, charges were brought against the wife of an employee of the 45th WOG - in connection with her alleged falsification of documents as part of offers submitted in public procurement procedures.

For financial liabilities that the court may order against suspects, among others: fine, forfeiture of property benefits and court costs, the prosecutor established property security in the total amount of over PLN 620,000 (in cash and as part of a compulsory mortgage on real estate).

This is the first implementation. The prosecutor does not exclude further detentions in this case.
