CBA files a notice to the Prosecutor’s Office

The Central Anticorruption Bureau has completed its control in the Lublin Municipality regarding the construction of a modern communication centre. The investigation revealed irregularities in the implementation of the investment and the possibility of damage to the Municipality’s assets.

Officers of the Regional Office of the CBA in Lublin, from May 29th 2023 to February 26th 2024, carried out a control of the decision-making and implementation procedures stipulated by law in the subject of the contract for the ‘Construction of the Integrated Transport Centre (ZCK) for the Lublin Functional Area (LOF)’. The contract for the construction of the transport centre was concluded between the Lublin Municipality, the Authority for Roads and Bridges in Lublin and the Public Transport Authority in Lublin, and the Contractor, Budimex S.A (Inc.).

Control Findings

On February 26th 2024, the auditee was served with an inspection protocol containing the findings. It showed that the actions of the representatives of the Lublin Municipality who supervised the investment could have caused damage to the Municipality’s assets of no more than PLN 7.5 million.

Abuse of power suspicion

On August 1st 2024, officers of the Regional Office of the CBA in Lublin filed a notice to the Regional Prosecutor’s Office in Lublin on a substantiated suspicion of a criminal offence under Article 231 § 2 of the Penal Code by persons responsible for supervising the implementation of the investment.

Outcomes of the CBA’s Control Activities

In 2023, CBA officers conducted 143 controls and 911 control cases and provided 855 pre-control analyses.

Nearly 60 controls concerned decision-making and implementation procedures for public procurement, financial support and the disposal of state or municipal property and the management of public funds.

In 31 cases, CBA controls resulted in a notice of substantiated suspicion of a criminal offence.
