Detentions related to unreliable VAT invoices

Officers from the Central Anticorruption Bureau and the Opole Customs and Tax Office in Opole detained two entrepreneurs in the Masovian Voivodeship for using fraudulent VAT invoices to understate their tax liabilities. The investigation is being supervised by the District Prosecutor’s Office in Ostrów Wielkopolski.

On October 28th of this year, officers from the Regional Office of the CBA in Poznań detained two men in Warsaw. They were entrepreneurs operating in the business consulting industry. The investigation was conducted jointly with officers from the Opole Customs and Tax Office in Opole. Officers seized financial and accounting documentation and electronic devices from the detainees' homes. Furthermore, officers discovered drugs and illegal pharmaceuticals.

Large-Scale Losses to the State Treasury

The investigation, conducted by officers from the Regional Office of the CBA in Poznań and the Opole Customs and Tax Office in Opole, concerns tax fraud. Findings indicate that between March 2022 and October 2024, the detainees issued VAT invoices for a gross amount of over PLN 260 million, which did not reflect actual economic transactions. The inaccurate VAT invoices were used in tax returns and JPK_VAT files submitted by several hundred entities. As a result of this criminal activity, the State Treasury could lose almost PLN 50 million.

Preventive Measures

The detainees were brought to the District Prosecutor's Office in Ostrów Wielkopolski, where they were charged with, among other things, participation in an organized criminal group, issuing fraudulent invoices (the so-called "VAT crime"), and money laundering. The court imposed preventive measures on the detainees, including police supervision, a ban on leaving the country, and a ban on contacting specific individuals.

The investigation is ongoing

This is the second development in the ongoing preparatory proceedings. Seven people have been charged so far. The case is ongoing. Further procedural steps are planned.
