Indictment in the Case of Damage Caused to GetBack S.A.

On 20 August 2026, the Prosecutor of the Regional Prosecutor’s Office in Warsaw filed an indictment with the Regional Court in Warsaw. The suspects are charged with, among other offences, causing substantial property damage, causing damage to creditors, accounting offences and restructuring offences.

The indictment concludes a multi-threaded preparatory investigation in which officers of the Regional Office of the CBA in Kraków  cooperated with officers of the Organized Economic Crime Department of the Warsaw Board of the Police Central Bureau of Investigation. The cooperation between the two services was carried out within a joint coordination team established to perform tasks related to the investigation. In the course of the proceedings, property was secured in the form of gold coins, works of art and paintings, vehicles and real estate, with a total value of nearly PLN 4 million.

Abuse of Powers and Failure to Perform Duties

The indictment concerns the actions of persons representing GetBack S.A., as well as members of its Management Board and Supervisory Board. The investigation established that the persons responsible for the company’s operations, acting with the aim of obtaining a financial benefit, allegedly abused the powers entrusted to them and failed to perform their duties. As a result of these actions, the company suffered substantial property damage, while the ability to satisfy the claims of its numerous creditors was simultaneously reduced.

Property Damage Exceeding PLN 1.3 Billion

The criminal scheme involved deliberately creating an improper financing structure for GetBack S.A., which resulted in the loss of the company’s financial liquidity and the emergence of negative equity. According to the findings of the investigation, the actions taken by the accused managers in cooperation with the former President of the Management Board of GetBack S.A. were intended to secure a financial benefit for an external entity. This mechanism led to the emergence of negative equity amounting to more than PLN 1.37 billion and ultimately to the company’s insolvency.
