Wielkopolska Highway returned 1.38 billion PLN to the budget after the CBA's control
The payment of 1.38 billion PLN made by Wielkopolska Highway SA (AW S.A.) to the account of the Ministry of Finance concerns the implementation of the European Commission's decision of August 2017, indicating, that Wielkopolska Highway SA must return 895 million PLN to the Polish state, including interest that has been recognized as overcompensation paid to the licensee.
Record-breaking - the highest in history payment to the State Treasury would not be possible, if it were not for the activities carried out by the Management of Control Proceedings of the CBA in 2008-2009, during the service management by Mariusz Kamiński. Just before the departure of Minister Kaminski from the position of the Head of the Central Anticorruption Bureau, control over the implementation by General Director of National Roads and Motorways of statutory tasks related to supervision and control in the construction and operation of the A2 turnpike has revealed numerous irregularities in settlements with the Wielkopolska highway.
The CBA agents determined, among others, that General Director for National Roads and Motorways (GDDKiA) did not take any actions to calculate and return by AW S.A. overpaid compensations for the period from September 2005 to October 2007. The compensations concerned the release from the obligation to pay fees of trucks with a valid vignette. As a result of the control, it was established that the amount of 197,588,646,00 PLN, which the public party could have demanded from Wielkopolska Highway due to overpaid compensations was significantly underreported to the actual overpayment, made by AW S.A. (by not taking into account the fact, that the actual overpayment of compensations lasted from September 2005, and not - as erroneously indicated the position of the public party of 3 August 2009 - to October 2007). After considering the findings and position of the CBA, the overpaid compensation was recalculated, this time correctly - for the total amount of overpayments in the amount of PLN 767,021.933,12, which in August 2017 was finally confirmed by the decision of the European Commission.
