New aspects of the GetBack case

The Warsaw CBA detained this morning seven suspects in a new thread of investigation related to the GetBack. Thus, the list of detainees in the intense proceedings of the Warsaw Regional Office of the Central Anticorruption Bureau and the Regional Prosecutor's Office in Warsaw regarding numerous irregularities in the operations of the GetBack SA capital group extended to 19 people.
Among the detained persons are: former vice-president of the GetBack S.A., managing director of the GetBack, director of the debt collection area and GetBack proxy, the owner of the Warsaw bailiff's office and people from the industry - the owners of companies associated with detainees.
The detentions took place, among others, in Warsaw, Grodzisk Mazowiecki and Sulejówek.
The first completely new thread of the investigation carried out by the CBA concerns a network of companies, which were beneficiaries of multi-million malpractices. In the case of those companies managed by the detainees, according to estimates, nearly 120 million zł were siphoned from the GetBack under the cover of unfavorable contracts.
In another new thread, investigative findings indicate that one of the members of GetBack's leadership could have influence on the fact, that indicted, specific persons were able to present their bonds to buy-out at the so-called good price and appropriate date.
The investigation conducted by the CBA Regional Office in Warsaw under the supervision of the Regional Prosecutor's Office in Warsaw concerns, among others, causing damage to property of great size in the economic turnover to the detriment of the GetBack SA, systematic siphoning of millions of zlotys from the company based on sham contracts in order to achieve personal gain, hide evidence, use counterfeit documents. The case also includes crimes of manipulation of financial instruments and public disclosure of untruth about the company's activities.
Previously, the CBA investigators worked intensely in this investigation, they secured volumes of documentation and electronic data. 12 persons were charged, 9 of them were temporarily detained.
On 16th June this year were detained - by agents from the Warsaw CBA Regional Office - at Chopin Airport, Konrad K. - former President of the Board of Getback SA, and in his home in Warsaw Ursynów Piotr B. - a representative of an economic entity that cooperated with the former President of the Board of Getback SA.
Former president of the Getback SA. Konrad K. was charged with, among other things: attempting to bring the Polish Development Fund to S.A. to an unfavorable regulation of its property, by misleading about the actual financial condition of the Getback SA and submitting unreliable documents for the Getback S.A. loans in the amount of 250 million zł and causing the Getback S.A. property damage of over 15 million zł on the basis of not implemented but paid off, apparent contracts for the provision of consulting and marketing services concerning the issuance of bonds and cooperation. Another allegation concerns a similar nature, an amount of at least 7 million zł and a contract "for the provision of services in the field of security in business". Detained by the CBA - Piotr B. heard accusations regarding this agreement and acting in order to obtain financial benefits. The former president of the Getback SA also heard the allegations of crimes concerning the public dissemination of false data in the current report of the company that could be misleading as to the value of financial instruments issued by the Getback S.A. company, against the prohibition of such manipulations on the market. On June 26, the CBA agents from Warsaw detained two more suspects: Katarzyna M. - former Director of the Office of the Board of the Getback SA and Szczepan D.-M. president of the Polish Brokerage House. Former Director of the Board Office of the Getback SA is suspected of destroying company's documents, covering up traces of committed crimes and helping their perpetrators to avoid criminal responsibility. She was also supposed to instruct persons associated with the Getback SA, what to do to effectively destroy evidence owned by them. President of the Polish Brokerage House - Szczepan D.-M. was charged by the prosecutor with acting jointly and in consultation with the former president of the board of the Getback SA, suspected Konrad K., to the detriment of this company. According to investigative findings, he was the co-founder of a network of companies which, based on sham contracts, served to siphon from the Getback SA amounts constituting property of great value.

The CBA officers also detained in Warsaw and the Mazowieckie Province former members of the Getback SA management board: vice-president Anna P., Marek P. and Bożena S., brother of the suspect S. Dariusz S. and Kinga M., who signed an apparent contract to the detriment of the company for over 4 mln zł. The charges against the five persons detained by the CBA concern, inter alia, causing the Getback SA damage to property in large sizes, misappropriation of more than 2 million zł from the Getback by transfer without legal title, use of previously falsified demand documents for early redemption of Getback SA bonds and an apparent contract for more than 4 million zł. Investigators determined that the detainees acted in order to gain financial benefit - jointly and in agreement, inter alia, with the former President of the Board of the Getback SA.
On 11th July this year, the CBA agents detained a businessman who was to invoke influences in special services and were to lead to the dissemination by the media of information compromising the majority shareholder of the GetBack S.A. The findings of the CBA and the prosecutor's office indicate that the businessman, while invoking influences in special services, in exchange for a financial gain of not less than 3 million zł in cash, was to take action to cause, among others, searches at the headquarters of the majority shareholder of Getback S.A. This, in turn, was to lead to the dissemination by the media of information compromising this shareholder. In order for the agreed money to be paid out, an apparent "service provision" contract was concluded. The illegal activities that were the subject of allegations occurred in the first half of 2018.
On Friday, August 31 this year, agents from the Warsaw CBA Regional Office detained members of the management board of one of the TFI based in Warsaw. Persons detained by the CBA were charged with causing the GetBack S.A. in the period from October 2016 to early August 2017, financial damage in large sizes, currently estimated at, at least 160 million zł. The case is related to the sale of an enterprise to the GetBack S.A., on behalf of investment funds managed by Towarzystwo Funduszy Inwestycyjnych, for the amount of over 207 million zł. The findings indicate that the actual value of the sold company did not exceed 47
Investigators also indicate that in a transaction related to the sale of the enterprise, men acted jointly and in agreement with other established persons in order to obtain financial benefits and were aware of its actual value. Charges to the former president of the board of GetBack SA and one of the former members of the company's management board, acting as the managing director were supplemented.
