Re-privatization - an official from Warsaw detained by the CBA

Five persons detained by officers of the Central Anti-Corruption Bureau in connection with the investigation into irregularities in Warsaw's re-privatization. The former mayor of Włochy District will also face charges in this case. These are the next steps in this multi-threaded investigation.

The officers of the Warsaw Regional Office of the Central Anti-Corruption Bureau detained five more people in the investigation into irregularities in Warsaw's re-privatization - among others one of the Warsaw developers, an employee of the City of Warsaw Office, legal advisor and person dealing with trade of claims.

After the activities were completed, the detainees were taken to the Regional Prosecutor's Office in Wrocław, where they will hear allegations of granting financial benefits to officials of the Capital City of Warsaw. The CBA agents have also searched the detainees' flats and one of the law firms in the Mazowieckie voivodship.

The former mayor of Włochy District, detained by the CBA in other proceedings, will also face the charge of giving a financial benefit in this investigation. The man was detained in the act of accepting 200,000 PLN from a well-known developer. In return, he issued administrative decisions regarding building conditions. the man detained in October, is the former mayor of Włochy District was detained for three months by court decision. Last week, the court decided to extend his arrest.

The officers from the Warsaw Regional Office of the CBA are currently conducting about 70 investigations under the supervision of the prosecutor's office regarding crimes related to re-privatization in Warsaw, which concern nearly 200 properties.

Investigators are constantly working on the collected material. The list of suspects is not closed.

In connection with the fact that the above mentioned investigation is developmental, the CBA informs that persons who granted financial or personal benefits to a person performing public function, in particular - officials of the Capital City of Warsaw - as part of administrative proceedings regarding the re-privatization of real estate in the Capital City of Warsaw, they can avoid criminal liability by using the so-called exemption from prosecution clause of art. 229 § 6 of the Penal Code.

The condition of avoiding criminal liability, if a financial or personal benefit or their promise has been accepted by a person performing public function, is voluntary notification of the authorities appointed to prosecute crimes - in this case the Regional Office of the CBA in Warsaw or the Regional Prosecutor's Office in Wrocław and disclosure of all relevant circumstances of the crime before law enforcement agencies will find out about them.
