A civil servant from Warsaw detained by the CBA. Moments earlier, he accepted a bribe
As a result of planned and coordinated official activities, the officers of the CBA Regional Office in Warsaw detained an employee of the Warsaw Internal Revenue Service, just after he accepted a several-thousand bribe. The money was handed in a café in Warsaw. According the findings of the CBA officer, the man demanded "gratification" in exchange for the stay of execution of enforcement of payments - a tax claim of several hundred thousand zlotys.
The evidence gathered by the CBA was forwarded to the District Prosecutor's Office in Warsaw. Once brought to the Prosecutor’s Office, the detainee will be subjected to further procedures.
The CBA recalls that individuals who got involved in corrupt practices and gave a financial advantage have the possibility to benefit from the so-called non-punishment provision under article 229 paragraph 6 of the Criminal Code.
Under the Criminal Code, a condition for avoiding criminal liability, if a financial or personal advantage or a promise thereof has been accepted by a person performing a public function, is a voluntary notification submitted to law enforcement authorities. The offender must inform about the fact before the law enforcement authority has heard about it from a different source, and disclose all significant circumstances of the criminal offence.
