Notice in the prosecutor's office. CBA analysis completed
The CBA has sent a notification to the public prosecutor's office after the completion of the analysis concerning the extension and reconstruction of the building of the Lubuskie Voivodeship Office (LUW) in Gorzów Wielkopolski.
The Control Proceedings Department of the CBA Regional Office in Poznań conducted analytical and informational activities concerning irregularities related to the extension and reconstruction of the building of the Lubuskie Voivodeship Office in Gorzów Wielkopolski. In particular, the officers examined the implementation of the public contract titled “Modernisation of the LUW building in Gorzów Wlkp. (Phase II)" and the performance of the smoke and heat control installation by the general contractor, in the years 2015-2016”.
The activities were conducted by the CBA officers from 22 July 2019 to 1 December 2020.
The analysis of the documentation gathered in the course of the proceedings revealed that the construction manager, as well as the construction supervision inspectors, had certified untruths in the construction documentation by confirming that it had been constructed in accordance with the construction design.
It was also established that the solutions adopted by the general contractor, as regards the construction of ventilation ducts of the smoke ventilation system, were questioned and found by an expert appointed by the LUW to be incorrect and incompliant with the construction design. The general contractor deviated from the approved construction design and arbitrarily applied its own replacement solutions, as a result of which the smoke ventilation ducts were found to be leaking. This resulted in damage to the assets of the ordering party in the amount of about PLN 4 million, as repair works.
It was also found that the civil servants of LUW in Gorzów Wielkopolski in charge of the proper implementation of contracts did not fulfil their duties.
In connection with the irregularities revealed in the course of the analysis, the CBA submitted a notification to the Circuit Public Prosecutor's Office in Gorzów Wielkopolski on a substantiated suspicion that criminal offences had been committed by the above-mentioned persons.
The notification was referred to the Regional Public Prosecutor’s Office in Szczecin.
