Further information in the case of the Mayor of Ostrowiec Świętokrzyski suspected of accepting a bribe
The application for the pre-trial detention of Jarosław G. was not accepted because, according to the District Court Katowice-Wschód in Katowice – although there is a high probability of committing the alleged act, the evidence against Jarosław G. is complete. The National Prosecutor's Office announces that it will lodge a complaint.
The officers of the CBA detained Jarosław G. on Thuseday, March 14 of this year, while performing his official duties when he left one of the city companies. CBA agents, supported by the officers of the Internal Inspection Office of the Ministry of Finance searched the detainee's place of residence, the City Hall and other locations in the Świętokrzyskie Voivodeship and secured documents and electronic data carriers that may be of evidentiary importance.
The investigation into this case is being conducted on suspicion of committing a crime by Jarosław G. consisting in accepting a material benefit in the total amount of at least 40,000 PLN, among others, in exchange for employing certain people. In the case, the following items were secured, among others: footage that was subjected to detailed analysis by investigators.
Due to speculations appearing in the media regarding the motives of the prosecutor's office and CBA officers in this case, the prosecutor conducting the investigation permitted to publish the secured footage. We publish this material below.
We would like to remind you that in accordance with Art. 229 § 6 of the Criminal Code, persons who became involved in corruption and provided a material or personal benefit to a person performing public function are not subject to punishment if the benefit was accepted by the person performing a public function and the person giving it notified the authority responsible for prosecuting crimes and disclosed all relevant circumstances of the crime before the authority learned about it.
In order to benefit from the immunity clause, persons who provided or promised to provide benefits to Jarosław G. should report to the Central Anti-Corruption Bureau or the Silesian Organized Crime Division of the National Prosecutor's Office in Katowice.
