Corruption charges against the mayor
On 12th November 2024, officers of the CBA Regional Office in Krakow detained the Mayor of the City and Commune of Radoszyce, and two women: the manager of the Shared Services Center and the director of the Public Health Care Center in Radoszyce. The investigation is supervised by the District Prosecutor's Office in Kielce.
According to the investigators' findings, the mayor of Radoszyce, while performing public functions, repeatedly accepted financial benefits in exchange for employing certain people in educational institutions or other units subordinate to the Radoszyce UMiGR. Additionally, he was charged with misappropriation of copyright of someone else's work.
The Director of the Public Health Care Center in Radoszyce was also charged with corruption, as she has accepted money in exchange for employing a person for an indefinite period. The manager of the Shared Services Center in Radoszyce is suspected of exceeding her authority and acting to the detriment of the public interest in connection with her disclosure (on the orders of her superior) of important information regarding the submitted offers to another entrepreneur, which was supposed to enable him to win the tender.
Officers searched 9 locations in the Końskie district, including the places of residence of the persons mentioned above and they also searched the offices where they were employed. Extensive evidence documentation and memory media were secured.
This is yet another procedural implementation. In the spring of 2024, CBA officers detained the Deputy Mayor of the Radoszyce Municipal Office in connection with suspected corruption.
Preventive measures
At the request of the prosecutor, the District Court in Kielce imposed temporary detention on the mayor of Radoszyce for a period of 3 months with the possibility of repealing it on condition that he pays PLN 25,000 as surety within 10 days, combined with police supervision and a ban on contact with the other suspects. The prosecutor filed an objection to the conditional detention at the hearing. With regard to the detained women, the prosecutor applied non-custodial preventive measures. The director of the Public Healthcare Center in Radoszyce has been suspended from her duties, and the prosecutor has applied police supervision and property bail to her. The prosecutor has also applied property bail and police supervision to the manager of the Shared Services Center in Radoszyce.
CBA Appeal
In connection with the ongoing proceedings, the Central Anti-corruption Bureau informs that persons who have been connected with corruption and have given a financial benefit, have the possibility of using the so-called non-punishability clause, specified in art. 229 § 6 of the Penal Code, which states: The perpetrator of the offence specified in § 1-5 shall not be subject to punishment if the financial or personal advantage or the promise thereof was accepted by a person performing a public function, and the perpetrator has notified the authorities responsible for prosecuting offences of this fact and disclosed all the relevant circumstances of the offence before the authorities found out about it.
