Acting to the detriment of the public interest
Officers of the Central Anti-Corruption Bureau detained an entrepreneur and two officials of the District Road Authority in Przasnysz. The detentions are related to a multi-threaded investigation into the granting of financial benefits to persons performing public functions, supervised by the Podlasie Branch of the Department for Organized Crime and Corruption of the National Prosecutor's Office in Białystok.
On 1 April 2025, officers of the Regional Office of the CBA in Białystok detained an entrepreneur operating in the road services industry, who had implemented many public procurement contracts in the field of roads and road infrastructure in the Przasnysz district. Officers also detained the director of the District Road Authority in Przasnysz and the head of the Investment and Public Procurement Section in this office.
Improper supervision
The findings of the preparatory proceedings indicate that officials, exceeding their authority, refrained from imposing contractual penalties for delays in the implementation of the road construction project. The officials failed to fulfill their obligations regarding proper supervision over the implementation of public procurement contracts at the level of the Przasnysz district. During the investment inspection, officials used documents submitted by the entrepreneur, knowing that they had been falsely certified as to the circumstances related to the delivery of road aggregates.
Unreliable documentation
The submitted unreliable documents allowed for the conclusion and signing of Annex No. 2 to the agreement with a retroactive date, under which the investment implementation deadline was extended. Thus, the public interest was harmed by the contractor's avoidance of payment of contractual penalties for delay in the implementation of the subject of the indicated agreement in the amount of 0.1% of the gross contractual remuneration of PLN 9,689,252.81 for each day of delay.
Preventive measures
The detainees were taken to the Podlaskie Branch of the Department of Organized Crime and Corruption of the National Prosecutor's Office in Białystok. The prosecutor charged the officials with exceeding their authority, failure to perform duties and intellectual forgery. The entrepreneur was charged with using a document confirming untruthfulness.
The suspects provided explanations. The prosecutor applied non-custodial preventive measures against them, including property bails in the amount of PLN 50,000 to PLN 80,000, police supervision, a ban on leaving the country combined with the seizure of their passports and a ban on contacting specific individuals. The officials were suspended from their official duties.
