Suspicion of tender fraud by the head of the Lublin Airport

CBA findings indicate that the President of the Airport of Lublin SA deliberately committed a tender fraud. The case concerns the order of voivodeship local government for the purchase of airline tickets for over 1.25 million PLN. The CBA submits a notice to the prosecutor's office.

The CBA Regional Office in Lublin controlled a tender worth 1 million 251 thousand PLN for booking and purchase of air tickets for the marketing project of Lubelskie Voivodship. To the ordering office were submitted eight bids, including an offer submitted by Lublin Airport SA (PLL SA), which was selected.

Bidders, in accordance with the Terms of Reference, had to fulfill certain conditions. One of them concerned the proper performance of services. Lublin Airport SA attached to its offer documents signed by the President of the Lublin Airport SA about the fulfillment of the conditions for participation in the procedure and the list of services performed in the last 3 years before the deadline for submission of bids. Included in the documentation was information about the services provided by the airport to the Romanian airlines SC Carpatair SA - stating that the contract is ongoing, and is still properly implemented.

This contract, however, was terminated by the Romanian carrier earlier in September 2014 due to lack of payment by the Lublin Airport SA. Therefore it is difficult to discuss in this situation about proper, ongoing performance of the Lublin Airport SA.

PLL SA joined the offer certified by the President of the Management Board as a true copy of the agreement with Carpatair. After the examination, it turned out, that the certified copy is significantly different from the original contract. In the copy, the content relating to the deposit was missing -  that is 400 thousand EUR, which were lost by PLL SA to Romanian carrier*.

The findings of the CBA officers indicate that the President of PLL SA deliberately indicated in his offer untrue circumstances in order to obtain a public contract.

The CBA has submitted a notice to the District Prosecutor's Office in Lublin on the possibility of committing a crime of tender fraud by the President of Lublin Airport SA, belonging to the category of economic crimes. The CBA also asked the prosecutor's office to entrust the whole investigation to the Regional Office of the CBA in Lublin.
