The CBA submits a new notification on crimes in re-privatization in Warsaw
A new, notification to the prosecutor's office of a justified suspicion of committing crimes by the Property Management Office employees concerning the re-privatization in 2012 and 2013 of three properties located in the center of Warsaw. The CBA Regional Office in Warsaw has been conducting so far more than 50 investigations on the so-called wild re-privatisation.
Central Anticorruption Bureau after the control procedures for the taking and execution of decisions regarding the disposal of public property, issued by the President of Warsaw, in particular pursuant to a decree of 26th October 1945 on the ownership and use of land in the area of the City of Warsaw in the years 2010-2016 filed another notice to the Warsaw District Prosecutor's Office about a reasonable suspicion of committing crimes related to re-privatization in 2012 and 2013 of three properties located in the center of Warsaw.
During the control, the CBA revealed the circumstances which gave reasons for reasonable suspicion of committing a crime by the staff of Property Management Office (BGN), who – in order to gain financial benefits - by failing to fulfill their obligations, acting to the detriment of the public interest, drafted and issued, under the authority of the President of the City of Warsaw, decisions on establishing the perpetual usufruct, specified in the property notice.
The CBA disclosed in the course of the control that the BGN employees indicated in the notice, prepared and issued decisions on the re-privatization of those properties in Warsaw, in situations where the gathered documentation indicated a lack of legal basis for re-privatization.
The CBA in its notification requested to entrust the activities - in the case of initiation of an investigation - to the Regional Office of the Central Anticorruption Bureau in Warsaw.
As we have already reported, the CBA’s control showed, that re-privatization of 12 - out of the 50 properties examined - was not conducted in accordance with applicable laws. Already during the CBA's control, among others, three notifications of suspicion of committing an offense during the re-privatization of Warsaw property were addressed to the prosecutor’s office.
The Regional Office of the CBA, under the supervision of the prosecutor's office, already runs more than 50 investigations on the so-called wild re-privatisation. Among them are the proceedings concerning dozens properties, and one of them concerns up to 50 addresses.
Officers of this Regional Office of the CBA in January detained five people, and in February three persons - in the investigation concerning irregularities in the re-privatization in Warsaw. Among the detainees was, among others, former official of the capital city hall, a lawyer, former deputy director of the Property Management Office of the Capital City of Warsaw and two other persons from this office, working at the time of detention in the local government units of Warsaw. Everyone were brought charges.
