The administrative receiver sold the conference and hotel center in Warsaw for a 21 million lower price in comparison to its real value. 5 people detained by the CBA.
The Regional Office of the Central Anticorruption Bureau in Warsaw, under the supervision of the Warsaw-Praga District Prosecutor's Office, conducts an investigation on the abuse of power by taking out money from the bankruptcy estate and acting to the detriment of eight bankrupt companies, among others, the owner of the hotel and conference center, railway infrastructure repair company, housing cooperative, construction company modernizing public hospitals, printing house and large paper warehouse.
One of the examined threads in the investigation is unfavorable - causing great damage - sale of the hotel and conference center in Warsaw. The administrative receiver should act in such a way as to make the best use of the bankrupt's assets to satisfy the creditors. It did not happen in this way.
The value of the company was at least 31 million 153 thousand PLN, and the administrative receiver led to its sale for less than a third of this amount - for 9 million 351 thousand PLN. The losses of the consortium are over 21 million 800 thousand PLN.
The officers from the Regional Office of the CBA detained 5 people involved in the case: the administrative receiver and the president of the company, who for over 21 mln PLN lower value of the hotel bought it, member of a board of directors of this company, its attorney and attorney of the administrative receiver.
In the investigation it was determined, that the court expert indicated by the administrative receiver, who estimated the hotel's value, did not – at all – have the qualifications of a property valuer and was not on the list of court experts.
The laconic content of the sales announcement, the short deadline and the method of the sale by the administrative receiver of the property worth tens of millions of zlotys, practically made it impossible for other bidders to submit themselves – except for the one that was ultimately chosen.
The CBA agents have searched two law firms and headquarters of three companies.
People detained by the CBA, were brought charges in the Praga District Prosecutor's Office. Charges of crimes against economic activity - the abuse of trust and property damage in large size, money laundering in order to obtain substantial financial benefits.
The prosecutor applied for a temporary arrest of Tomasz S. - the administrative receiver.
The investigators do not rule out further detentions and enlargement of the list of charges.
