An appeal for the use of an unpunishability clause. Investigation into corruption inspector from PiP

The investigation on corruption of inspector from the National Labor Inspectorate in Lodz is still ongoing. She accepted construction works in her home in exchange for not punishing fines. We know that there are more such cases of corruption. We appeal to entrepreneurs who have been entangled in this practice, to report to the CBA and use the unpunishability clause specified in the Code.

Agents from the CBA Regional Office in Łódź got on the trail of corrupt practice conducted by an inspector from the District Labor Inspectorate in Łódź - National Labor Inspectorate. The woman while controlling construction companies from Łódź and the surrounding area, for her "favor" and for not issuing fines, took illegal benefits. At the current stage, the CBA agents determined, that the bribes were not in money - the inspector was finishing her house - and the controlled companies had to help her with that free of charge. The value of such construction services - bribes varied from several hundred zlotys with minor works to several thousand zlotys for larger works.

In the Łódź-Śródmieście district prosecutor's office, the detainee heard corruption charges. The inspector was arrested by a court decision for 3 months.

The CBA agents from Łódź have confirmed several such cases from 2016-2017. At the same time, the CBA agents suspect that the scale of the illegal conduct was much greater - on the basis of evidence already collected.

The Central Anticorruption Bureau informs the entrepreneurs who, as a result of the corruption proposals submitted to them, have been entangled in this procedure and who handed over a financial benefit - there is a possibility of using the so-called the unpunishability clause resulting from art. 229 para. 6 Penal Code.

Pursuant to the Penal Code, the condition of avoiding criminal liability, if the financial or personal benefit or their promise was accepted by a person holding a public function, is a voluntary notification to the law enforcement authorities - in this case the Regional Office of the Central Anticorruption Bureau in Łódź or the District Prosecutor's Office in Łódź-Śródmieście. The perpetrator must inform about this fact before the authority will find out about him and must reveal all the relevant circumstances of the offense.
