Detained for bribes

A former employee of the Office of the Marshal in Katowice and a representative of a Silesian company have been detained by the Central Anti-Corruption Bureau.

The officers of the Regional Office of the CBA in Katowice have been carrying out an investigation into accepting and giving of financial and personal advantages by the employees of the Office of the Marshal in Katowice. The investigation has been carried out together with the District Prosecutor's Office in Częstochowa.  Today, a former deputy director of the Department of Environment Protection of the Office of the Marshal in Katowice and a representative of a Silesian company have been detained in connection with this case. During the course of the investigation, it has been established that the company delivered sand for the construction of the Pyrzowice – Woźniki stretch of A1 motorway.

The evidence gathered indicates that in 2016 the civil servant accepted financial advantages in return for an acceleration of an issuance of administrative decisions, beneficial to the company. The decisions were connected with the management of waste stored in the sand pit. After the completion of procedural activities, the detainees will be taken to the District Prosecutor's Office in Częstochowa, where they will hear charges.

These are the first detentions in this investigation. 

Due to the pending proceedings, the CBA informs all individuals who have given a financial advantage and thus got involved in the case that they may take advantage of the so-called non-punishment provision resulting from article 229 paragraph 6 of the Criminal Code.

Under the Criminal Code, if a personal or a financial advantage was accepted by a person performing a public function, to avoid criminal liability one is obliged to inform voluntarily a law enforcement authority - in this case, the Regional Office of the CBA in Katowice, address: 1-go Maja 123, tel. + 48 22 437 32 00.

The perpetrator must inform about the fact before the law enforcement authority has heard about it from a different source. The offender must also disclose all circumstances of the criminal offence.
