Further activities in the privatisation of CIECH

The CBA officers of the Regional Office in Wrocław and the Silesian Local Division of the Department for Organized Crime and Corruption in Katowice have been conducting proceedings concerning irregularities in the privatisation of Ciech S.A., including a failure to comply with the obligations and abuse of powers for a financial gain by persons obliged to deal with State Treasury property.

It concerns the sale by the State Treasury of 37.9% of shares in Ciech S.A., in response to the public call of KI Chemistry from the Kulczyk Investments group, for an amount not less than PLN 619 million, which caused a large-scale detriment to the State Treasury.

Due to the extensive evidence gathered, the prosecution has changed the legal classification of the charges presented against the former deputy minister of the Treasury, who held the function in the years 2012-2014 and supervised that privatisation, the then counsellor to the minister, a director and a chief specialist at the Ministry of Treasury. They were all detained by the CBA in February 2018. At that time, they were charged with abuse of powers intended to obtain a financial gain. Now, the prosecution has extended the qualification of the act to include the abuse of the powers granted, thereby causing damage in property amounting to almost PLN 52 million, for a financial gain. The suspects face up to 10 years in prison.

The investigation is in progress. Further procedural activities are planned in connection with the investigation.
