CBA control activities - September 2020

In September 2020, inspections were initiated by three Regional Offices of the Central Anti-Corruption Bureau: in Białystok, Szczecin and Wrocław.

The Central Anti-Corruption Bureau conducts control activities on the basis of annual control plans approved by the Head of the CBA. The Bureau's inspection usually takes 3 months. In particularly substantiated cases, its duration may be extended by the Head of the CBA for a maximum of 6 months. The purpose of the CBA control is to check and juxtapose the existing state of affairs with the required and expected state; to determine the scope and reasons for possible discrepancies, as well as to communicate the results of the findings to both the entity under inspection and the superior entity. As part of its control activities, the Bureau verifies and corrects any irregularities in order to ensure the effectiveness and correctness of the operation of public sector units.

• On 14 September 2020, the officers of the Control Procedure Division of the CBA Regional Office in Białystok initiated an inspection entitled "The control of the procedures for making and implementing decisions on awarding a public contract in 2018 titled "Installation of solar panels for DHW production in the Ciechanowiec Municipality".

The audit was preceded by analytical and intelligence activities, which determined its commencement. Currently, the inspectors are investigating the correctness of the public procurement procedure entitled: "Installation of solar panels for domestic hot water production in the Ciechanowiec Municipality". They are interested in accounting for the parties and calculating contractual penalties due to non-performance or undue performance of the contract.

• On 17 September 2020, the officers of the Control Procedure Division of the CBA Regional Office in Szczecin initiated an inspection entitled "Control of the procedures for making and implementing decisions on the disposal of the public property concerning the thermal modernisation of the penitentiary building A, B and the administrative and office building in the area of the Custody Centre in Szczecin".

The control covered the process of making and implementing decisions on thermal modernisation of the buildings of the Custody Centre in Szczecin in the years 2014-2015. The areas under special attention are the following: applying for and accounting for the financial support from the National Fund for Environmental Protection and Water Management (NFOŚiGW) in the amount of PLN 3,637,934, as well as the performance of and accounting for the construction works agreement concluded with the general contractor carrying out the thermal modernisation. Currently, an analysis of the documentation gathered so far is underway.

• On 28 September 2020, the officers of the Control Procedure Division of the CBA Regional Office in Wrocław initiated an inspection entitled "Control of municipal property disposal by the Municipality of Legnica, covering the disposal of residential and commercial premises in the years 2015-2019".

The inspectors have been examining the sale of premises under an open oral tender and by way of invitation to negotiation, with particular consideration given to procedures in which the sale price reached a minimum value and in which individual bidders took part - which could have placed them in a favourable position.
