Pre-control analysis in the Municipality of Pszczew concluded with a notification to the prosecutor's office

From 22 September 2020 to 16 December 2020, the Unit for Control Proceedings of the Regional Office of the Central Anti-Corruption Bureau in Poznań conducted a pre-control analysis concerning the calculation by the Agricultural Property Agency (ANR) of a contractual penalty to the Municipality of Pszczew for failure to develop, as intended, the real estate transferred to the Municipality by the ANR.

In the course of the activities conducted by the CBA, it was found that in 2005, the Agency transferred, free of charge, two real properties to the Pszczew Municipality, located in the municipality area, intended as a public recreational and tourist service area, as well as for municipal infrastructure and isolating greenery. The properties were to be developed within 10 years of the date of purchase. During the inspections carried out between 2008 and 2015, the ANR concluded that the municipality did not comply with the contractual obligation to develop the properties. They were used contrary to the agreement - for agricultural purposes by third parties, initially under lease agreements and later under non-contractual use. As a result, ANR calculated a contractual penalty in the amount of PLN 2,162,373.39.

In the course of the activities, it was established that the person responsible for the above irregularities was the Head of the Pszczew Municipality, who held the office in the years 1998-2018.

As a result of the completed pre-control analysis, on 18 February 2021, the CBA submitted a notice to the District Prosecutor's Office in Gorzów Wielkopolski, on a reasonable suspicion of an offence having been committed by the former Head of the Municipality, who by his conduct exhausted the elements of the offence under Article 231 § 1 of the Criminal Code, i.e. he did not fulfil his duties, acting to the detriment of the municipality which he managed.
