Judgment of the Court of Appeal in Rzeszów in the case of two suspects in the so-called Podkarpacie scandal
On 28 June 2021, the Court of Appeal in Rzeszów pronounced the ruling in the case concerning the defendants in one of the threads of the so-called Podkarpacie scandal:
Tadeusz Ch. - former head of the Tax Control Division in the Second Tax Office in Rzeszów was accused of abuse of powers to obtain a financial gain.
The Court of Appeal in Rzeszów upheld the judgment of the Regional Court in Rzeszów of 8 August 2019 against the accused Tadeusz Ch. in whole, sentencing him to 1 year of imprisonment with a conditional suspension for a probation period of 2 years, a fine and a ban on holding positions in tax administration bodies for 3 years.
Zygmunt P. – president of the Management Board of one of the companies in Rzeszów, accused of submitting documents to the Office of the Marshal of the Podkarpackie Voivodeship attesting an untruth to obtain a subsidy of PLN 2,034,000.00, and misleading the employees supervising the execution of a project co-financed with EU funds to bring about unfavourable disposal of property of a significant value in the amount of PLN 1,440,000.00, and an attempt to bring about unfavourable disposal of property of a significant value in the amount of PLN 594,000.00.
The Court of Appeal in Rzeszów changed the appealed decision of the District Court in Rzeszów, imposing on the defendant a punishment of 3 years’ imprisonment and a fine.
Moreover, the Court of Appeal in Rzeszów adjudged in favour of the auxiliary prosecutor, i.e. the Marshal's Office of Podkarpackie Voivodship, the amount of PLN 700,000.00 as the obligation to partially redress the damage caused by the crime, taking into account that the amount of PLN 740,000.00 was already paid to the account of the auxiliary prosecutor as a partial return of the subsidy.
