Holding liable for invoking influence

Three persons detained by the CBA as part of the investigation involving invoking influence in a state-owned company have been charged. The court applied pre-trial detention against two of them.

The CBA Regional Office in Warsaw has been carrying out an investigation involving invoking influence in a state-owned company and acting as an intermediary in obtaining commercial contracts in exchange for a promise of financial advantage. According to the investigators' findings, the bribe took a form of a commission on each acquired order. The proceedings were initiated on the grounds of the evidence gathered by the officers of the CBA Regional Office in Warsaw. The investigation has been carried out under the supervision of the Małopolska Local Division of the Department for Organized Crime and Corruption in Kraków.

The CBA officers detained three persons, including a former vice-president of Katowice Holding Węglowy (Coal Holding - KHW), a former member of the management board of this company, and an entrepreneur. They were all charged with invoking influence in a state-owned company. The court granted the prosecutor's request for the application of remand in custody against two detainees. The prosecutor applied non-custodial preventive measures against the third detainee, including police supervision and bail in the amount of PLN 100,000.

It has been established that in exchange for the promise of a commission in the amount of 15% of the contract value, the KHW management board member and persons close to him undertook to facilitate one of the companies to conclude beneficial contracts for HR services for large entities. The orders were to consist primarily in the so-called optimization of the value of National Fund for Rehabilitation of Disabled Persons (PFRON) contributions, which large companies are obliged to pay. The charges presented against the detainees cover the years 2015-2016.

Further findings and activities are being conducted in connection with the case.
