Bribes for favourable tender awards at PSG Sp. z o.o. (Polish Gas Distribution System Operator) - another detainee
A tender specialist at a Warsaw construction company detained by the CBA. Previously, a former manager of the Polish Gas Distribution System Operator and a Mazovian entrepreneur were detained in this investigation. The activities are ongoing.
Officers of the CBA Regional Office in Poznań, under the supervision of the Regional Prosecutor's Office in Szczecin, have been investigating demands and acceptance of financial advantages by a person holding a managerial position in the Polish Gas Company in return for abuse of powers or failure to perform duties involving obstruction of public tenders, entering into agreements with other persons and activities constituting acts of unfair competition or unacceptable preferential practices in connection with conducted tender procedures.
The investigation instigation was based on evidence gathered by officers of the CBA Regional Office in Poznań.
During the investigation, evidence was gathered indicating that the former head of the Investment and Repairs Department of the Gas Distribution Unit in Gorzów Wielkopolski of the Polish Gas Distribution System Operator demanded and subsequently accepted at least PLN 160,000 from identified entrepreneurs in connection with public tenders conducted by the Company. The bribe constituted "remuneration" in exchange for unacceptable preferential activities involving a deliberate extension of bidding time limits, preparation of cost estimates in favour of bidders, ensuring the possibility of performing additional works and other tasks to ensure that the selected bids were considered to be the most advantageous. As a result, these entrepreneurs were awarded service contracts for, among other things, the construction of high-pressure gas pipelines, other construction services, and the development of gasification concepts for pipeline construction.
The financial advantages were payments for fictitious consultancy services, allegedly provided by him to the bidders, as part of his business activities.
Due to further findings, on Tuesday, officers of the CBA Regional Office in Poznań detained a tender specialist from one of the Warsaw construction companies with a branch in Chorzów. The man had entered into an agreement with the persons detained earlier in the case and had participated in the transfer of financial advantages to a person who was committing acts of unfair competition. The detainee has already faced charges in the Regional Prosecutor's Office in Szczecin. The prosecutor applied non-custodial preventive measures against him, including bail, police supervision, a ban on leaving the country and a ban on contact with certain persons.
The case is in progress. Further detentions may take place.
